Terms of service
1. Parties and scope
These terms apply to all agreements for Minecraft server hosting that you enter into with Ejgil Møller Hovedskou, trading as Headwood Hosting, Åvænget 2, 5463 Harndrup, Denmark, e-mail Headwoodhosting@gmail.com ("Headwood Hosting", "we"). The terms apply to consumers and business customers. Where mandatory consumer rules give you better rights, those rules always apply.
To order, you must be at least 18 years old or have the consent of a parent or guardian, who is then the customer and responsible for the agreement.
2. The service
We provide a Minecraft server on shared infrastructure with the RAM, CPU share, disk space and number of backups shown for the chosen plan on the order page. You manage the server in our control panel (start/stop, console, files, backups, plugins/mods and software).
- The resources are the maximum limits for your server. How many players, plugins or mods a server can handle depends on the world and the add-ons, and we do not guarantee a specific number.
- You are responsible for the content, files, plugins and mods that you upload or install, and for having the right to use them.
- We provide support via Headwoodhosting@gmail.com to a reasonable extent.
3. Ordering and conclusion of the agreement
You order by choosing the game, server type, version and plan, creating an account with an e-mail address and password, accepting these terms and completing the payment. The account is only activated once the payment has been completed. If an order is not paid, the account is deleted automatically after 48 hours. The agreement is concluded when we have confirmed the order by e-mail. The confirmation contains the terms of the agreement and a link to these terms. We then create the server automatically.
4. Prices and payment
All prices are per month and are final prices. No VAT is charged, as the seller is not VAT registered. No fees are added to the price shown. The base price is in Danish kroner. The currency you see and pay in is set automatically from the country your internet connection (IP address) comes from: Denmark, Greenland and the Faroe Islands pay in DKK, the United Kingdom in GBP, Sweden in SEK, Norway in NOK, Poland in PLN, Switzerland and Liechtenstein in CHF, the USA in USD and all other countries in EUR. The currency cannot be chosen manually. The prices in each currency are fixed and rounded, not a running exchange-rate conversion, and the price shown is the price you pay. Your own bank may charge a currency exchange fee. Payment is made by card through our payment provider Stripe. We do not see or store your full card details.
The first month is paid when you order. After that, the amount is charged automatically in advance of each new month to the same card. You receive a receipt by e-mail for every payment.
5. Subscription, renewal and price changes
The subscription runs one month at a time and renews automatically until it is cancelled. There is no minimum term.
We may change the price with at least 30 days written notice by e-mail. The change applies from the first billing period after the notice period ends, and you can cancel the subscription before the change takes effect.
If a payment fails, we will let you know and try again. If the payment has not been completed 7 days after it was due, the server may be suspended (see section 11).
6. Cancellation
You can cancel the subscription at any time yourself in the control panel under Account → Manage billing, or by writing to Headwoodhosting@gmail.com. The cancellation takes effect at the end of the month you have already paid for, and the server runs up to and including that date. You will receive a confirmation by e-mail.
After the subscription has ended, you can still log in for 30 days to see receipts and download your files and backups until they are deleted as described in section 12.
Paid time is not refunded on cancellation unless you withdraw from the agreement (section 7) or there is a defect that entitles you to a price reduction (section 8).
7. Right of withdrawal (14 days)
If you are a consumer, you have a 14-day right of withdrawal under the Danish Consumer Contracts Act. The period runs from the day the agreement is concluded.
Starting right away
The server is normally created a few minutes after you order, that is, before the withdrawal period ends. This only happens if you expressly request, when ordering, that delivery starts right away. If you then withdraw within the 14 days, you only pay for the days you have had the server until you tell us that you are withdrawing. The amount is calculated proportionally from the monthly price per started day. The rest is refunded.
The right of withdrawal lapses if the service has been fully delivered before the period ends and you have expressly accepted beforehand that the right of withdrawal lapses once the service has been fully delivered.
How to withdraw
Before the period ends, you must send us a clear statement that you are withdrawing: by e-mail to Headwoodhosting@gmail.com or with our withdrawal form. You do not have to use the form.
Refund
We refund the amount owed as soon as possible and no later than 14 days after we have received your statement. The refund is made to the same means of payment you used, unless you have expressly agreed otherwise. There are no fees. The server and its data are deleted as described in section 12.
8. Defects and complaints about the service
If the service does not match the agreement, you can make a claim under the general rules of Danish law. Write to Headwoodhosting@gmail.com within a reasonable time after you discovered the defect. Describe the defect and say which server it concerns. We will first try to fix the defect. If we do not succeed within a reasonable time, you may, depending on the circumstances, claim a proportionate price reduction or terminate the agreement.
9. Operation, maintenance and downtime
We aim for stable operation but give no uptime guarantee. The server may be unavailable during planned maintenance, updates, faults at our suppliers, denial-of-service attacks or other circumstances beyond our control. Planned maintenance is announced in advance where possible.
In the event of significant and prolonged downtime caused by us, you can, after making a claim, receive a proportionate price reduction for the affected period.
10. Backups and your data
The plan gives access to a number of backups that you create and restore yourself in the control panel. Backups are stored on the same server and therefore do not necessarily protect against loss of the whole machine. We recommend that you download copies of important worlds yourself.
In addition, we take regular backups as part of operations: daily snapshots of our own database (accounts and orders) and backups at our hosting provider Contabo. These backups are a service, not a guarantee that data can always be restored. You are responsible for keeping your own copies of important world data. Our liability for loss of data is limited as far as Danish law allows, see section 13. The limitation does not apply in cases of intent or gross negligence.
11. Suspension and termination
We may temporarily suspend your server if:
- payment has not been completed 7 days after it was due,
- the server is used in breach of the acceptable use rules, or
- the server poses an acute risk to the security or operation of other customers' servers.
Where possible, we will notify you first, but in the event of acute risk or gross abuse, suspension may happen without notice. In the event of a material breach, for example a gross or repeated breach of the acceptable use rules, we may terminate the agreement. Data is not deleted during a suspension until the period in section 12 has expired.
12. Deletion of data after the agreement ends
When the agreement ends, we stop the server. The server's files, worlds and backups are permanently deleted 30 days after the end. Until then, you can get access to download your files by contacting Headwoodhosting@gmail.com. Information we must keep under the Danish Bookkeeping Act is stored as described in the privacy policy.
13. Limitation of liability
We are liable under the general rules of Danish law. We are not liable for indirect losses, for example loss of profit, loss of data that you could have secured with your own backups, or losses caused by plugins, mods or files that you have installed yourself. Our total liability is limited to the amount you have paid for the affected server in the last 12 months.
These limitations do not apply if we have acted intentionally or with gross negligence, and they do not apply to the extent that mandatory consumer rules give you better rights.
14. Personal data about your players
Your server may process information about the players who log in (for example player names, IP addresses and chat logs in the server's log files). You are the controller of this information, and we are the processor. We only process it to provide the hosting service and according to your instructions, as set out in these terms and through your use of the control panel. We ensure appropriate security and confidentiality, only use the sub-processors listed in the privacy policy, and delete data when the agreement ends as described in section 12.
15. Minecraft
Headwood Hosting is an independent service and is not affiliated with Mojang Studios or Microsoft. Using Minecraft server software requires that you accept the Minecraft End User License Agreement and follow Mojang's guidelines for commercial use, for example the rules on selling advantages on your server.
16. Changes to the terms
We may change the terms with at least 30 days notice by e-mail. Material changes to your disadvantage give you the right to cancel before they take effect.
17. Complaints
If you have a complaint, please contact us first at Headwoodhosting@gmail.com. If we cannot find a solution, you can as a consumer complain to:
- Center for Klageløsning (the Danish Centre for Complaint Resolution), Nævnenes Hus, Toldboden 2, 8800 Viborg, Denmark. Complaints are submitted via forbrug.dk or naevneneshus.dk. The centre can mediate between the parties and forward the case to the relevant complaints board.
- If you live in another EU country, you can get help from Forbruger Europa (the European Consumer Centre in Denmark).
The European Commission's online dispute resolution platform (ODR) has closed, and complaints can no longer be submitted that way.
18. Governing law and jurisdiction
The agreement is governed by Danish law. Disputes are settled by the Danish courts. As a consumer, however, you always keep the rights you have under mandatory rules in the country where you live, including the right to bring a case before the courts where you live.
